Federal Court Orders Release of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks lawful basis.
"Since his release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his return to the United States to answer human smuggling allegations, he was detained in immigration custody.
In her decision, the court pointed out that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
